Welcome to Qwikshore Courier. These Terms and Conditions of Service ("Terms") govern your use of our website at www.qwikshorecourier.com and the courier, freight forwarding, last-mile delivery, and bearer and delivery services we provide (collectively, the "Service"), operated by Qwikshore Courier, a partnership registered in Jamaica under the Registration of Business Names Act.
Our Privacy Policy also governs your use of the Service and explains how we collect, safeguard, and disclose information that results from your use of our web pages. Together, these Terms and our Privacy Policy form the entire agreement between you and Qwikshore Courier (the "Agreements").
By accessing or using the Service, you acknowledge that you have read and understood the Agreements and agree to be bound by them. If you do not agree, please contact us at [email protected] before using the Service.
By using our Service, you agree to receive service-related communications, including booking confirmations, delivery updates, and operational notices. You may opt out of marketing communications at any time by following the unsubscribe link or emailing [email protected].
The Service is intended only for individuals at least eighteen (18) years of age. By accessing or using the Service, you represent that you are at least eighteen (18) years old and have the full authority, right, and capacity to enter into this agreement. Entities (companies, government bodies, partnerships) may use the Service through an authorised representative who warrants they have authority to bind the entity.
When you create an account with us, you warrant that the information you provide is accurate, complete, and current. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use at [email protected].
We reserve the right to refuse service, suspend, or terminate accounts at our discretion, including where we have reasonable grounds to believe that a user has breached these Terms.
Qwikshore Courier provides courier, air freight forwarding, last-mile delivery, and bearer and delivery services (collectively, "Carriage Services") as an independent contractor. In arranging Carriage Services, Qwikshore Courier acts as agent for the customer where applicable and as principal in its own right where it performs services directly. Nothing in these Terms constitutes Qwikshore Courier a common carrier.
Qwikshore Courier's maximum liability for loss, damage, misdelivery, or delay of any shipment, howsoever caused, shall not exceed the total freight charges actually paid by the customer for the specific shipment giving rise to the claim. This cap applies whether the claim arises in contract, tort, negligence, or otherwise.
Where a shipment is carried by air, whether domestically or internationally, carriage is subject to the Warsaw Convention (as amended by the Hague Protocol) or the Montreal Convention 1999, as applicable. To the extent those conventions impose a lower liability limit than the cap in Clause 5.2, the convention limit shall apply. The customer acknowledges that Qwikshore Courier, as a freight forwarder, is not itself an air carrier and that the liability of the operating carrier is governed by the carrier's own conditions of carriage.
In no event shall Qwikshore Courier be liable for any indirect, special, or consequential loss or damage arising from loss, delay, damage, or misdelivery of a shipment, including but not limited to loss of profits, loss of business, loss of contracts, loss of revenue, or loss of anticipated savings, even if Qwikshore Courier has been advised of the possibility of such losses.
The liability cap in Clause 5.2 reflects the standard freight charge and does not represent the insured value of any shipment. Qwikshore Courier does not provide cargo insurance. It is the sole responsibility of the customer to arrange adequate insurance coverage for the full value of any shipment. Qwikshore Courier accepts no liability for the customer's failure to obtain such insurance.
Any claim for loss, damage, or misdelivery must be made in writing to [email protected] within the following timeframes, failing which the claim shall be deemed waived and absolutely time-barred:
(a) Visible damage or partial loss: written notice within three (3) calendar days of the delivery date, or at the time of delivery if damage is apparent;
(b) Total loss or non-delivery: written notice within fourteen (14) calendar days of the expected delivery date;
(c) Delay claims: written notice within seven (7) calendar days of the actual delivery date.
All claims must include the booking reference, a description of the alleged loss or damage, and supporting evidence (photographs, packing list, or other documentation) where available. Qwikshore Courier will issue a written determination within twenty-one (21) calendar days of receiving a complete claim submission.
The customer shall ensure that all shipments are adequately and securely packaged suitable for the nature of the goods and the mode of carriage. Qwikshore Courier shall not be liable for loss or damage caused or contributed to by inadequate packaging, inherent vice of the goods, or the customer's failure to comply with applicable packaging or labelling requirements.
By tendering any shipment to Qwikshore Courier, the customer warrants that: (a) the contents are accurately described and declared; (b) the shipment does not contain any item listed in Clauses 6.2 or 6.3; (c) the shipment complies with all applicable laws of Jamaica, the country of origin, and any country of transit or destination; and (d) all required licenses, permits, or customs declarations have been obtained or made.
The following items are prohibited from carriage under all circumstances and will not be accepted: firearms and ammunition; explosives and detonators; dangerous chemicals and flammable substances; controlled drugs and narcotics; human remains or organs; live animals; counterfeit goods; child sexual abuse material; currency exceeding limits prescribed under the Proceeds of Crime Act (Jamaica); radioactive material; and any item prohibited by Jamaica Customs or applicable Jamaican law. This list is non-exhaustive.
The following items may be accepted only with prior written authorisation from Qwikshore Courier and subject to compliance with all applicable regulatory requirements: perishable goods; pharmaceuticals and medical devices; alcoholic beverages; tobacco products; high-value items with a declared value exceeding JMD 100,000; fragile items requiring special handling; items requiring temperature-controlled storage; and commercial quantities of goods subject to import duty or GCT.
Qwikshore Courier reserves the right to refuse, return, or retain any shipment that it reasonably believes contains prohibited or restricted goods, or that is inadequately described, without liability to the customer and at the customer's cost. Qwikshore Courier further reserves the right to open and inspect any shipment where it has reasonable grounds to suspect non-compliance with these Terms, applicable law, or the requirements of any regulatory authority, customs agency, or air carrier.
The customer shall fully indemnify and hold harmless Qwikshore Courier, its partners, employees, and agents from and against any and all losses, costs, fines, penalties, legal fees, and third-party claims arising from the customer's breach of the warranties in Clause 6.1 or from the carriage of any item described in Clauses 6.2 or 6.3 without authorisation. This indemnity shall survive termination of these Terms.
A "Force Majeure Event" means any event or circumstance beyond the reasonable control of Qwikshore Courier that prevents or delays performance of its obligations, including but not limited to:
(a) Acts of God, including hurricanes, tropical storms, flooding, earthquakes, and other natural disasters;
(b) Acts of government or regulatory authority, including port closures, customs holds, quarantine orders, curfews, states of public emergency, or any order issued under the Disaster Risk Management Act (Jamaica);
(c) Civil unrest, riots, strikes, or industrial action not involving Qwikshore Courier's own workforce;
(d) Failure or disruption of utilities, telecommunications, or internet infrastructure;
(e) Fuel shortages or sudden and significant increases in fuel costs that render performance commercially impracticable;
(f) Epidemic, pandemic, or public health emergency declared by a competent Jamaican or international authority;
(g) Actions or delays of third-party carriers, airlines, or customs authorities outside Qwikshore Courier's reasonable control.
Where Qwikshore Courier is prevented from or delayed in performing any obligation by a Force Majeure Event, that obligation shall be suspended for the duration of the event. Qwikshore Courier shall not be in breach of these Terms and shall not be liable for any loss arising directly or indirectly from such prevention or delay.
Qwikshore Courier shall, as soon as reasonably practicable, notify the affected customer by any available means (including WhatsApp, email, or telephone) of the nature of the event, its expected duration, and the likely impact on the customer's shipment. Qwikshore Courier shall use all reasonable endeavours to mitigate the effects and resume performance as soon as practicable.
If a Force Majeure Event continues for more than thirty (30) consecutive calendar days, either party may terminate the affected booking on seven (7) days' written notice, without liability to either party. Any freight charges paid for the affected shipment shall be refunded, less any costs incurred by Qwikshore Courier up to the date of termination.
All freight charges, service fees, and applicable taxes (including General Consumption Tax where applicable under Jamaican law) are due and payable at the time of booking unless Qwikshore Courier has agreed in writing to extend credit terms. No shipment shall be collected, processed, or dispatched until full payment has been received and confirmed.
Qwikshore Courier accepts payment via WiPay Jamaica, Lynk, bank transfer to Qwikshore Courier's designated account, or such other methods as Qwikshore Courier may publish from time to time. Cash payments may be accepted at Qwikshore Courier's discretion and are subject to a receipt being issued at the time of payment. Qwikshore Courier does not accept personal cheques.
Where Qwikshore Courier has agreed in writing to extend credit terms to a corporate or government client, invoices shall be payable within the period stated in the relevant service agreement or purchase order. Where no period is stated, invoices are due within fourteen (14) calendar days of the invoice date. Qwikshore Courier reserves the right to suspend credit facilities and require advance payment for any client whose account is overdue by more than seven (7) calendar days.
Without prejudice to any other rights or remedies, Qwikshore Courier reserves the right to charge interest on overdue amounts at the rate of two percent (2%) per month (or the maximum rate permitted by applicable Jamaican law, whichever is lower), calculated from the due date until the date of actual payment. Qwikshore Courier may also recover reasonable costs of collection, including legal fees, from the defaulting customer.
Qwikshore Courier shall have a general lien over all goods and documents in its possession or control for all sums due and owing from the customer, whether in respect of the specific shipment or any other outstanding amount. Qwikshore Courier may exercise this lien by retaining the goods until all outstanding sums are paid in full. This lien shall survive termination of any individual booking or service agreement.
Where a shipment cannot be delivered due to the customer's unavailability, an incorrect or incomplete delivery address, refusal of delivery, or any other reason attributable to the customer, Qwikshore Courier will make reasonable efforts to arrange redelivery or collection. Storage charges will accrue as follows:

If a shipment remains uncollected for twenty-one (21) calendar days after the first attempted delivery or notification, Qwikshore Courier will send a final written notice to the customer's last known contact details (including by WhatsApp or email) advising that the shipment will be treated as abandoned if not collected or redelivery arranged within a further seven (7) calendar days. All accrued storage charges and outstanding freight charges must be paid before the shipment will be released.
Where a shipment is not collected within the notice period in Clause 9.2, or where Qwikshore Courier is unable to contact the customer after reasonable attempts, Qwikshore Courier may, at its absolute discretion and without further liability:
(a) Sell the goods by private treaty or public auction and apply the proceeds first to all outstanding charges (including storage, freight, and costs of sale), with any surplus held for the customer for ninety (90) days before being forfeited;
(b) Donate the goods to a charitable organisation where sale is impracticable; or
(c) Dispose of the goods as waste where they have no realisable value or have deteriorated beyond use.
Notwithstanding Clauses 9.1 to 9.3, where an uncollected shipment contains perishable goods, goods that pose a health or safety risk, or goods requiring temperature-controlled storage that Qwikshore Courier is not equipped to provide, Qwikshore Courier may dispose of such goods immediately and without notice, without liability to the customer.
These Terms and any dispute, claim, or matter arising out of or in connection with them, or their subject matter or formation (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of Jamaica.
Before commencing any formal proceedings, the parties agree to attempt to resolve any dispute in accordance with the following escalation pathway: (i) informal written notice (14 days); (ii) senior escalation within Qwikshore Courier (7 days); (iii) mediation through the Mediation Council of Jamaica (30 days); and then (iv) court proceedings. Completion of steps (i) and (ii) is mandatory before referral to mediation.
The party raising a dispute shall send written notice to the other party describing the nature of the dispute, the relief sought, and the factual basis for the claim. The receiving party shall respond in writing within fourteen (14) calendar days. The parties shall negotiate in good faith during this period.
If the dispute is not resolved within the fourteen (14) day period in Clause 10.3, either party may escalate to a senior representative (partner or principal) of Qwikshore Courier, who shall issue a written determination within seven (7) calendar days of escalation.
If the dispute remains unresolved following Clause 10.4, either party may refer it to mediation administered by the Mediation Council of Jamaica ("MCJ") in accordance with the MCJ's mediation rules in force at the time of referral. The mediator shall be appointed by agreement or, failing agreement within seven (7) days, by the MCJ. The mediation shall be conducted in English in Kingston, Jamaica, or by remote means as agreed. Mediation costs shall be shared equally unless otherwise directed by the mediator. All mediation proceedings and any settlement terms are confidential. Any settlement shall be recorded in writing and signed by both parties, and shall be binding as a contract. Mediation shall be deemed concluded upon written settlement, declaration by the mediator, or the expiry of thirty (30) days from referral without settlement, unless extended by written agreement.
If the dispute is not resolved through mediation, either party may commence legal proceedings in the courts of Jamaica. For claims within the monetary jurisdiction of the Resident Magistrate's Court, proceedings shall be commenced in the Resident Magistrate's Court for the Parish of Saint Catherine unless both parties agree otherwise. For claims exceeding that jurisdiction, proceedings shall be commenced in the Supreme Court of Jamaica.
Nothing in this Clause 10 prevents either party from seeking urgent injunctive or other interim relief from a court of competent jurisdiction where delay would cause irreparable harm.
Each dispute shall be resolved on an individual basis. The customer agrees not to bring or participate in any class action, collective, or representative proceeding against Qwikshore Courier in any jurisdiction. This Clause 10.8 shall survive termination of these Terms.
Nothing in this Clause 10 limits the right of a consumer customer to refer a complaint to the Consumer Affairs Commission of Jamaica in accordance with the Consumer Protection Act 2005 (as amended). Qwikshore Courier commits to cooperating fully with any inquiry conducted by the Consumer Affairs Commission.
You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service in any way that violates applicable Jamaican or international law; to harm, exploit, or expose minors to inappropriate content; to transmit unsolicited commercial communications (spam); to impersonate Qwikshore Courier or any other person or entity; to infringe upon the rights of others; or to engage in conduct that restricts or inhibits anyone's use of the Service.
You also agree not to use any automated device, process, or means to access the Service for any unauthorised purpose; introduce viruses, malware, or other harmful material; attempt unauthorised access to any part of the Service or connected systems; or take any action that may damage or falsify the Company's reputation or ratings.
All content found on or through this Service is the property of Qwikshore Courier or is used with permission. You may not distribute, modify, transmit, reuse, download, repost, copy, or use said content, whether in whole or in part, for commercial purposes or personal gain, without express advance written permission from us.
The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Qwikshore Courier and its licensors. Our trademarks and trade names may not be used in connection with any product or service without the prior written consent of Qwikshore Courier.
We may use third-party service providers to monitor and analyse use of the Service for the purposes of improving our operations and customer experience. Any such providers are required to handle data in accordance with our Privacy Policy and applicable Jamaican law.
Qwikshore Courier processes personal data in accordance with the Data Protection Act 2020 (Jamaica) and our Privacy Policy, which is available at www.qwikshorecourier.com. By using the Service, you consent to the collection and processing of your personal data as described in the Privacy Policy. You have the right to access, correct, or request deletion of your personal data by contacting us at [email protected].
To the fullest extent permitted by applicable Jamaican law, the Service is provided on an "as is" and "as available" basis without representations or warranties of any kind, whether express or implied. Nothing in this Clause affects any statutory rights you may have as a consumer under the Consumer Protection Act 2005 (as amended) that cannot be excluded or limited by contract.
Except as prohibited by applicable Jamaican law, Qwikshore Courier's aggregate liability to you for any claim arising out of or in connection with these Terms shall be limited as set out in Clause 5 (Carriage, Liability and Claims). In no event shall Qwikshore Courier be liable for indirect, punitive, special, incidental, or consequential damages except to the extent that applicable Jamaican law prohibits such exclusion.
Our Service may contain links to third-party websites or services not owned or controlled by Qwikshore Courier. We assume no responsibility for the content, privacy policies, or practices of any third-party websites. We strongly advise you to read the terms and privacy policies of any third-party websites you visit.
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms. All provisions of these Terms that by their nature should survive termination shall do so, including ownership provisions, warranty disclaimers, indemnity, limitations of liability, and Clause 10.8 (No class proceedings).
We may amend these Terms at any time by posting the revised version on this site with an updated effective date. Your continued use of the Service after any amendment becomes effective constitutes your acceptance of the revised Terms. We will make reasonable efforts to notify registered customers of material changes by email or WhatsApp.
No waiver by Qwikshore Courier of any term or condition shall be deemed a further or continuing waiver of such term or condition. If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, that provision shall be limited to the minimum extent necessary and the remaining provisions shall continue in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Qwikshore Courier regarding the Service and supersede all prior agreements and understandings between the parties relating to the subject matter herein.
